Has any one ever filed a patent?
« on: January 12, 2009, 10:21:48 PM »

Has any one ever filed a patent? Thought I'd ask as we have a few guys who have invented things. Anyways if you have any advice? Did you do it yourself or use a attorney?

Yea, I spent a lot of money on a patent lawyer for nothing.

Sherri,

It will be expensive to file a patent through a lawyer, and there is no guarantee that the money will be well spent.  On the other hand, if you have an invention that you are seriously convinced will generate a lot of money, it may well be worth it to hire a lawyer.  There is no guarantee that a lawyer will succeed in writing a bullet-proof patent, but the odds are that the lawyer will do a better job than someone who doesn't write patents on a routine basis.  The lawyer will not only know how the application should be drafted, but also where and when the application has to be filed.  Common sense dictates that other enterprising people will try to copy your invention if they believe they can enrich themselves by doing so. If your invention really turns out to be a cash cow and if it is protected by a well-drafted patent, an unscrupulous business person with the capital to exploit your invention may be inclined to negotiate with you for a license to use your invention rather than to just steal it.  Before spending any money on a lawyer though, you should definitely bounce your idea off several successful business people to best determine the true marketability of your invention.  You should view the money you would spend on a lawyer as an investment in your invention just as much as any other money you would spend to bring you invention to market.   How much you are willing to invest will depend on how convinced you are, after a careful and thorough investigation, that your invention is going to be a money-maker.  Like all investments, your investment will carry a substantial risk, no matter how rosey the picture.  Good luck, no matter what you decide to do.

One thing you should before you discuss it with anyone is do a write up and drawings of you invention. Measurements and discreption of how it will be used!!
MAKE IT AS DETAILED AS YOU CAN!!!  Make copies and take one of these to the post office and mail it to yourself as registered mail... This is to document the date of you idea.... This will only be opened if someone tries to take your idea and then only by your atturny... you will also need to resurch to see that someone else has not already received a patent on the same thing... :cuss: :cuss: :banghead: :banghead:I hope this will help protect your idea!!!
PS GOOD LUCK!!!! :c :c :c

I hold the patent for fire and the wheel.

ok...I lied about fire, God holds that one. I'm not that old.
but I did do the wheel.  ;)
